The Alberta Court of Appeal has released its much-anticipated decision of Qualex-Landmark Towers Inc v 12-10 Capital Corp., 2024 ABCA 115. The decision has further clarified some of the murky waters of environmental remediation priorities versus secured lending. We will go through the decision and what it means in our day to day practices.
