Title: The Public-Private Nature of Charity Law

Presenter: Dr. Kathryn Chan

Abstract: Is charity law a “private law” or a “public law” discipline?  And why should we care?  Kathryn Chan’s presentation will address both of these questions, situating them within the current trend towards social enterprise and other models of “for-profit philanthropy”.  Kathryn will argue that before we embrace these models wholeheartedly, we should reflect on the delicate balance that charity law has historically struck between protecting the autonomy and individualism of philanthropists, and furthering competing public visions of the good. 

Bio: Dr. Kathryn Chan is an Assistant Professor at the University of Victoria Faculty of Law, where she teaches Non-Profit Sector Law, Administrative Law, Constitutional Law, and Law and Religion.  Between 2009 and 2013, she undertook doctoral research on comparative charity regulation as a Trudeau Foundation Scholar at the University of Oxford. In 2015, she received the Scholarly Paper Award from the Canadian Association of Law Teachers for her article entitled “The Co-optation of Charitable Resources by Threatened Welfare States.”   Her first book, The Public-Private Nature of Charity Law, was published by Hart Bloomsbury in November 2016.  She previously practiced at a boutique charity law firm in Vancouver, and is a former executive member of both the national and BC branches of the CBA Charity and Not-for-Profit Law Subsection.

Title: Charity Law Symposium Review

Abstract: This session will provide an overview of the 2017 CBA Charity Law Symposium held in Toronto, May 12, 2017. Topics that will be reviewed include: administrative law issues in Canadian charity law; recent charity and not-for-profit cases and how these decisions affect advice given to clients; revenue-generating activities conducted by registered charities; an update from the CRA Charities Directorate regarding the work of the Directorate; voluntary disclosure by not-for-profits and registered charities; international aspects of donations of art; the concept of a shared platform.
