Trans Mountain Pipeline Decisions - Jurisdictional Issues
This meeting is being hosted by the Aboriginal Law - Vancouver Section, in partnership with the Constitutional/Civil Liberties Section.

Synopsis

Recent court decision regarding the Trans Mountain pipeline (including Tsleil-Waututh Nation v. Canada (AG), 2018 FCA 153, Squamish Nation v. British Columbia, 2018 BCSC 844 and City of Burnaby v. Trans Mountain Pipeline ULC, 2017 BCCA 132) have raised interesting and important jurisdictional issues in respect of the roles and powers of the parties to the cases, which included the federal government, the provincial government, local governments and indigenous governments. Michelle Bradley,  counsel for the City of Burnaby and the Squamish Nation, and Paul Seaman, counsel for Tsleil-Waututh First Nation, will present on and lead a discussion regarding some of the jurisdictional issues arising in these cases and their implications.
