Synopsis
Johanna Goosen discusses the Alberta Court of Appeal's decision in Auer v Auer, 2022 ABCA 375, and canvasses the issues that are expected to be addressed by the Supreme Court of Canada on appeal. This appeal clarifies the approach to the review of subordinate legislation and regulations under the Vavilov framework.
Johanna is counsel for WorkSafeBC, who has filed a motion for leave to intervene before the SCC in the Auer v Auer and Transalta Generation Partnership v Alberta (Minister of Municipal Affairs), 2022 ABCA 381 appeals.
