Synopsis
On February 9, 2024, the Supreme Court of Canada upheld the constitutionality of Bill C-92, the federal statute affirming Indigenous peoples’ right of self-government with respect to child and family services. In BC, amendments in 2022 to the Child, Family and Community Service Act laid a path for Indigenous peoples in BC to exercise jurisdiction over child and family services. Today, a number of Indigenous communities across BC and Canada are exercising jurisdiction while many more have started along a path to reclaiming responsibility over child and family services.
Leah Greathead, Dr. Sarah Morales (Su-taxwiye), and Crystal Reeves explore these historic changes and the impact that the Supreme Court decision on Bill C-92 will have in BC and beyond. Leah Greathead was the lead counsel for the Province before the Supreme Court on the Bill C-92 proceeding. Crystal Reeves supported Splatsin First Nation in negotiating the historic first coordination agreement in British Columbia. Dr. Sarah Morales (Su-taxwiye) is a Cowichan Tribes member and University of Victoria Faculty of Law Associate Professor who is currently supporting Cowichan Tribes on their path to reclaiming responsibility over child and family services under Cowichan law.
