Synopsis
As the Canadian population ages, an increasing number of people risk falling victim to elder financial exploitation. Lawyers who work with older adults need to understand and appreciate the regulatory framework as well as the operational and commercial realities that might impact key financial intermediaries, such as banks, when responding to actual or suspected elder financial exploitation.
Raphael Tachie discusses the following topics:
- The emerging legislative and regulatory framework relating to how financial intermediaries are to respond to elder financial abuse
- The operational and commercial realities that impact how financial institutions might respond to and prevent suspected financial exploitation
- Practical tips for lawyers when dealing with financial intermediaries in the context of elder financial exploitation, including how to draft a power of attorney to help financial intermediaries to appropriately respond to elder financial exploitation
- Alternative approaches using cross-discipline, client-centered case management, conciliation and collaborative approach to dealing with elder financial exploitation
