Synopsis
Donors who wish to transfer land or interests in land to create a protected area often have difficulty finding legal and financial advisors who are familiar with the available options, and the potential tax incentives such as the Ecological Gifts Program.
Private land conservation presents a unique mix of legal and financial considerations, and a well-informed advisor can make a big difference to the result, for both the donor and for recipients of the gift. Margaret Sasges, KC, Peter Johnson, Dave Cunnington, and Paul Peterson, explain how to advise your conservation-minded clients. They cover topics such as interests in land that can be donated, sales at less than market value, the costs and tax benefits under various scenarios, and other relevant topics from real estate, estate and charity law.
About the Speakers
David Cunnington is the BC Ecological Gifts Program Coordinator at Environment and Climate Change Canada. He assists donors of ecologically sensitive land to access significant income tax benefits, provides support to Land Trusts and other recipients, and has been involved in approximately 160 donations of land and conservation covenants across BC.
Margaret Sasges, KC, is the founder of Camas Law in Victoria BC and has been practising in the area of conservation law for over 20 years. She advises both owners of environmentally valuable land as well as conservation organizations, on how to best structure the future ownership of the land to ensure its conservation value is supported and maintained for generations to come.
Paul Peterson is a lawyer working with The Nature Conservancy of Canada and with other land conservation organizations and land owners on land conservation projects across the country. He works from his home in Kelowna, B.C.
Peter Johnson is a partner with the law firm Stewart McDannold Stuart in Victoria BC. While Peter's practice largely focuses on local government law, he has also acted for The Nature Conservancy of Canada, other conservation organizations, and various local governments on land conservation projects throughout the Province.
