Course Details:

Stuck with a high conflict/demanding client and want to get off the file? How to fire a client and still maintain your professional obligations to the client?  How do you make sure to still get paid? How to avoid a complaint to the Law Society, but if there is a complaint, how to stay calm and how does the Law Society try to resolve it at the early stages.

Neil Hain of the Law Society will discuss common complaints from high conflict clients and provide suggestions on how the complaints may have been avoided, as well as discussing the complaint process and tips for lawyers in dealing with complaints at the early stages.  Simon Kent and Morag MacLeod, Q.C., both senior lawyers, will provide examples of some of the ethical and practical issues that arise from firing difficult clients, including when to decide that the retainer cannot continue, the payment of legal fees and ensuring the clients have adequate time to retain other counsel.
