Course Details: One in five Canadians will experience a mental illness in their lifetime. Consequently, lawyers in all practices are increasingly being called on to solve problems of mental capacity regarding their clients. These problems can be pressing. How to determine a client’s capacity to instruct counsel, for example in drafting a will? or a trial? How to advise clients or their families after a client’s involuntary admission to a mental health facility? This course will provide lawyers with sensible answers to issues of mental capacity, from both a solicitor’s and litigator’s perspective. The course also provides a rare insight into the practice and procedure of BC’s Mental Health Review Board. The Mental Health Review Board is an independent tribunal that conducts review panel hearings for patients involuntarily admitted to a mental health facility under the Mental Health Act.
