TOPIC: Delay in Child Protection Proceedings

This session will address the Constitutional requirement for a fair and prompt post-apprehension hearing as set out in the cases of The Director of CFS v. KLW [2000] 2 SCR 519 as well as The Director of CFS v. H.H. and C.G. 2017 MBCA 33.
Discussion will center around the reforms to the Queen's Bench in Winnipeg to address timely adjudication of Child Protection matters. The panelists will discuss delay from the perspective of counsel for families, counsel for Agencies and the Bench. This session will focus on obligations on the parties and identifying skills to adapt to being better prepared for quicker hearings and quicker settlement discussions.
