SPEAKER: Dr. Amar Khoday, Associate Professor, Faculty of Law, Robson Hall 

This session discusses the use of undercover police officers to surreptitiously interrogate individuals in detention (cell-plant operations) and actively elicit incriminating statements. The presenter will examine the decisions of various trial courts concerning the right to silence and its relevance to the admission of such statements. These judicial developments build on the Supreme Court of Canada’s jurisprudence in the 1990s concerning cell-plant operations and the meaning of “active elicitation.”
