Criminal cartel enforcement is in a state of transition in the U.S. and Canada. There have been changes in the leadership of U.S. Department of Justice Antitrust Division and the Competition Bureau, and the Bureau is in the process of reviewing and revising its Immunity and Leniency Programs to reflect recent court decisions and prosecutions in Canada.

The Antitrust Division and the Competition Bureau have also deepened their coordination in certain investigations, but appear to have charted different paths on the issues of individual accountability and the effectiveness of incarceration. To discuss these and other current enforcement trends, the recently appointed Acting Deputy Assistant Attorney General for Criminal Enforcement at the Antitrust Division will join the even more recently appointed Interim Commissioner of the Competition Bureau and two senior practitioners to discuss the state of enforcement, coordination among regulators in cross-border investigations, and recent decisions in the U.S. and Canada relating to recent penalties and practice, and disclosure issues relevant to amnesty/leniency/immunity applicants.
