The IP Day Debates are back!

The IP Day Debates are back! Following on last year’s success, this year’s PD program will once again feature prominent members of the IP bar facing off against each other on topical IP litigation issues.

Here are this year’s debate resolutions…

Be it resolved that:

1.     Production of draft expert reports should not be required except in the rarest of cases.

2.     The Federal Court’s jurisdiction extends to tort, contract and other claims that are incidental to a claim that is within the Court's jurisdiction.

3.     All trademark and copyright infringement cases must proceed by application if the monetary relief sought is less than $500,000

4.      The time has come to abandon the rule against file wrapper estoppel in patent matters in Canada.

5.      It is improper to use s. 45 proceedings under the Trade-marks Act as part of a broader dispute between parties and the Federal Court should impose serious sanctions when s. 45 is used in those situations. 

6.      Application programming interfaces (APIs) are, and should be, protected by copyright.
