Focus:
Administrative justice is constantly evolving. With the constant flow of new decisions from the courts, and from tribunals themselves, it is a challenge to stay current. Our expert speakers will review recent decisions on what is expected in tribunal reasons; the evolving standard of proof; the "he said-she said" conundrum and findings of credibility; "hot tubbing" and other trends in expert testimony; and the ever-present issue of questioning by the tribunal-how much is too much? We'll conclude with a round table on the different perspectives of participants in a hearing, including a discussion of tribunal counsel's role and the challenges faced by adjudicators and advocates.
