Employment issues regularly emerge in every business, but there are specific concerns that arise in the franchise context.  These concerns can complicate the relationship between a franchisor and its franchisees.  Ontario’s Changing Workplaces Review issued its final report on May 23, 2017.  Its recommendations, if implemented, may significantly impact franchisors’ responsibilities.  Franchisors and franchisees need to be aware of the issues that may give rise to exposure, and consider what they can do to mitigate their risk regarding employment issues in franchising.

  • Unionization within franchising
  • New employment standards and enforcement
  • The “joint employer” issue
  • Exercise of control by franchisors over franchisees (including training, manuals and other documents)
