OBA Charity and Not-For-Profit Law PROGRAM | Original Program Date: Spetember 18, 2018
The courts dealt with two areas of charity law this summer that affect all practitioners in the areas of charity and not-for-profit law: religion and political activity. Learn about the implications of three cases on charities in Canada, as well as the wider consequences of these cases to freedom of religion and freedom of expression in Canada:
- Highwood Congregation of Jehovah’s Witnesses (Judicial Committee) v. Wall
- Trinity Western University v. Law Society of Upper Canada
- Canada Without Poverty v. AG Canada
Join us for an analysis of these decisions, including the reasonableness of a law society to refuse accreditation of a university wishing to start a law school as well as the limits imposed by Canada Revenue Agency on the percentage of resources a Canadian charity can expend on political activities. Our speakers will review the expulsion of membership in a religious organization and the power of the courts to review the expulsion of a member in a private, religious organization.
