OBA Child & Youth Law / Criminal Justice PROGRAM | 5:00 PM to 6:00 PM
In R. v. D.B., the Supreme Court of Canada recognized the fundamental differences between youth and adults who commit crimes, which entitles young people to a presumption of diminished moral blameworthiness. Too often, lawyers fail to appreciate the uniqueness of the Youth Criminal Justice system. Join us to explore the key underlying rights, duties, philosophy and principles of the Youth Criminal Justice system, including:
- Why the youth and adult systems are kept separately
- The need for enhanced procedural rights for young people
- What are the unique obligations of police officers in communication with and arrest of youth?
