Navigating Environmental Liability in Insolvency and Bankruptcy Proceedings

May 30, 2019
Toronto ON

OBA Environmental Law PROGRAM | 7:30 AM to 9:30 AM

This program is also part of the 2019 Environmental Law Passport Series.

Is the intersection between insolvency and environmental law still "messy?" Or is a modus operandi beginning to develop as the players involved – the Ministry of the Environment, lenders, debtors, creditors, monitors, receivers – are creatively using the tools available and navigating the pitfalls that occur when companies file for receivership or bankruptcy?

Attend this program to hear from the experts to update your tool kit in managing the environmental risks and liabilities that can arise when companies fall into financial distress. Learn about the Supreme Court of Canada’s decision in Newfoundland and Labrador v. AbitibiBowater Inc. and the application of AbitibiBowater in Northstar and Nortel. Gain an understanding of top-of-mind issues that must be resolved during a CCAA or bankruptcy proceeding, including whether and when Ministry orders are stayed and the priority given to environmental claims. Our speakers will help you think outside the box to find creative solutions to complex issues to arrive at win-win-win situations for the company, the environment and the community affected.

This program will also discuss the Supreme Court of Canada's recently released decision in Redwater and its potential implications, if any, on the Ontario insolvency landscape.
