THE JOYS AND TERRORS OF PENSIONS IN MEDIATION
This meeting is being hosted by the ADR-Nanaimo Sections.

Synopsis

Colin is passionate about pensions and is a frequent speaker to lawyers, mediators, and allied professionals across BC and the Yukon.  The complexity of dividing pensions on relationship breakdown can be daunting — in the mediation context, Colin’s role is to provide the full range of division options and issues under the specific plan(s) and the applicable legislation, to answer questions and ultimately, on the parties’ instructions, to prepare the pension division agreement for filing with the plan administrator.

Common pension issues that require particular attention include:

  • Correctly identifying the type of pension plan (defined benefit/defined contribution/target benefit, commenced or not)
  • Beneficiary designations (irrevocable or not);  
  • Ensuring income security for life where possible;
  • Jurisdictional issues (not all pensions are divided the same);
  • “Grey divorce”; age differences between parties; terminal illness; foreign pensions
  • Drafting tips and traps

In addition to his pension division practice, Colin is legal counsel to pension plan boards of trustees and plan administrators that range in size from $3m to $500m.
