Synopsis

Sharon Strand Ellison will be joining us remotely via live webcast

In this interactive webinar, we’ll first (1)  look at the physiological impact of defensiveness and how ADR lawyers and mediators can inadvertently prompt clients and even each other to react defensively, (2)  identify some of the pitfalls in currently recognized best ADR communication practices, (3) examine how four simple changes can greatly enhance the skills needed to quickly defuse defensiveness, even in high conflict situations.

We’ll then apply those changes to skill building for: 

 (1) asking questions that can prompt clients to move out of defensive posture; (2) giving direct feedback about patterns that are disrupting the process of resolution, using a series of steps that increase the likelihood that clients will feel respected and want to listen; (3) providing information or make statements, when appropriate, in ways that enhance understanding rather than alienating one or more parties; and (4) making predictions that create boundaries essential to holding a safe space and giving clients the ability to foresee various consequences of certain choices they might make.

Sharon Strand Ellison is an international communication consultant, an award-winning speaker, and the author of Taking the War Out of Our Words. Sharon has developed a communication process that gives people the ability to defuse defensiveness, often instantly, even in high-conflict situations. The guest speaker at the 11th annual Kaplan Lecture, Sharon received an honorary award as a pioneer in the field of communication.
