Beneficial Ownership Registers, Part II - BC Business Corporations Act Amendment to Require Transparency Registers

Synopsis

The Business Corporations Act has been amended to require non-public BC companies to keep a register, i.e. a list, of "significant shareholders". The Ministry of Finance will provide an overview of the new provisions, as well as guidance on the meaning of certain key terms including “indirect control” and "direct and significant influence". 

The presentation will also canvass applicable exclusions from the requirement to keep a transparency register and, time permitting, key differences between the provisions of these BCBCA requirements and the applicable CBCA rules that recently came into force.
