Synopsis

The test for prima facie family status discrimination involving familial obligations in the context of employment - first articulated by the BC Court of Appeal in its Campbell River decision in 2004 – was the subject of mixed reviews from courts, human rights tribunals and labour arbitrators in British Columbia and elsewhere over a period of 15 years or so. Supporters of the test appreciate its context-sensitive analytical lens and recognition that an employer's duty to accommodate cannot reasonably be triggered by the many commonplace conflicts which arise between work and family duties. Detractors argue that the test creates an inappropriate higher threshold for human rights protection than exists for other types of discrimination claims.

The test was unequivocally affirmed in Suen v. Envirocon Environmental Services, ULC, 2019 BCCA 46.

Join Fred Wynne, counsel for the complainant, and James Kondopulos, Michael Wagner and Brandon Hillis, counsel for the respondent, as they review the facts and issues in the Envirocon case and the significance of the Court of Appeal's decision in February 2019 and the Supreme Court of Canada's denial of the complainant's application for leave to appeal in August 2019.
