PRIVACY CONSIDERATIONS - TRANSGENDER INDIVIDUALS AND THE WORKPLACE

Synopsis
Michela Fiorido and Preston Parsons will provide an overview of the application of privacy law principles pertaining to the personal information of transgender individuals, including individuals who are gender non-conforming. The presentation will include a discussion of:

  • Concepts and terminology
  • The intersection of privacy and human rights law
  • Over-collection of personal information such as gender identity 
  • Overview of applicable transgender case law
  • Hiring process for transgender applicants, including pre-employment screening and references
  • Post-hire privacy considerations
  • Appropriate data collection practices

Speaker Profiles
Michela Fiordio advises within the entertainment and performing arts sectors on a range of commercial, contractual and labour issues. Michela also advises and represents public and private sector employers generally on employment, human rights and privacy law matters, including the implications of technology in the workplace. Michela has a strong track record of success in a variety of athletic, cultural and academic endeavours. She brings a keen sense of practicality and problem-solving to the legal issues she helps her clients resolve. Michela joined Harris as an articled student, and became an associate in September 2015.

Preston Parsons is a lawyer at Overholt Law and practices in the firm's core areas of labour relations law, employment law, and human rights law. Preston has experienced a wide breadth of legal practice and procedure and has appeared at the BC Court of Appeal, Supreme Court and Provincial Court for employment litigation and advocacy, mediations, and more. He has also appeared at the BC Labour Relations Board, BC Human Rights Tribunal and in federal labour arbitration proceedings. He has summered, articled, and practiced in downtown Vancouver since 2009.
