Recent legislative change has resulted in the NB Energy and Utilities Board having jurisdiction to make cost awards in favor of intervening parties to utility rates proceedings. This session will include a general review of the Board and its various mandates, jurisdiction and Rules of Procedure as an administrative tribunal. The process to apply for intervenor status and the Board’s pre-hearing process will be reviewed. Counsel with experience appearing before the Board will also review the conduct of rate hearings designed to assist counsel taking on such a file in navigating the process. Finally, the session will review the basic tenets of the law and protocols around utility ratemaking and the common issues and points of debate which often emerge during a rate proceeding.
