During the summer, the provincial government filed a regulation which sets out the circumstances around which a Commissioner of Affidavits can remotely commission a document in Ontario. For any lawyer commissioning affidavits in Ontario, this is a significant change. Part of our discussion will focus on what is in the regulation and how to commission a document remotely as well as what basic technology requirements you need, how to undertake identification verification, what records need to be retained and best practices to guard against potential pitfalls.
