
New Mandatory Trial Timelines in Alberta

The Court of King’s Bench of Alberta has announced a requirement that all new non-family civil cases filed after September 1, 2025, must include a litigation plan targeting trial within 36 months. While the goal is commendable, the requirement may not, on its own, have much effect on systemic delay, since the reform lacks enforceable penalties and ignores major court scheduling issues. Can counsel find creative solutions to support the spirit of the announcement and cut down delay?
