
Sealing the Deal in Family Mediation and Judicial Settlement Conferences: Tips & Traps

Mandatory pre-court mediation and judicial settlement conferences are now the norm in Alberta Family Law proceedings. And with legislated duties under the Divorce Act to advise and facilitate family dispute resolution processes to the extent appropriate to do so, arguably Family lawyers now have both legal and ethical obligations to assist parties to resolve their Family Law disputes out of Court and in non-adversarial processes. Family lawyers are being called on to up our game in dispute resolution, the “art of settling” and sealing the deal in mediated settlements. When is a deal a deal? How to seal the deal (so you don’t end up in Court)? What is a good enough deal? Is there a “standard of care” for Family lawyers in mediated or collaborative processes? Our speakers will share tips and traps from different vantage points, draw on legal and ethical principles, highlight what we can take from reported decisions when agreements are challenged - and suggest best practices for sealing the deal - in and out court.
