Arbitration After the Bench: Reflections from Former Justices Turned Arbitrators

Presented by the CBA Alberta Alternative Dispute Resolution (South) Section

This presentation on arbitration moves beyond a technical discussion of arbitration, and provides a rare opportunity to hear directly from two former justices about how decision-making changes from the bench to private dispute resolution.

We will explore how advocates can better present a case to an arbitrator versus a judge; what effective case management looks like from the decision-maker's perspective; and the strategic advantages and limitations of arbitraiton in today's litigation environment.

The Decision-Maker:
- How arbitration differs in practice from adjudication on the bench
- Procedural design and flexibility
- How arbitration advocacy should differ from courtroom advocacy
- Approaches to award writing and decision-making
