
Secession and Treaty Rights under s 35 of the Constitution Act

The Alberta government has decided to include a provincial secession question in the October 2026 referendum, despite legal concerns about its clarity, constitutionality, and whether Indigenous treaty rights were properly considered. The talk explores court rulings that found a duty to consult Indigenous peoples may have been triggered, the possible outcomes of Alberta’s appeal, and what the case could mean for treaty rights and reconciliation in Alberta.
