
Utmost Good Faith, Peace of Mind, and Extra-Contractual Damages in Insurance Coverage Cases

Since the early 2000’s, Canadian case law has established that, in some circumstances, an insurer may be liable to pay extra-contractual damages to its insured. However, Canadian jurisprudence has not always clearly or consistently identified the legal basis for claiming or awarding such damages. With a view to providing some practical assistance for advancing and defending these claims, this presentation will review prevailing principles and discuss outstanding issues relevant to the awarding of damages for mental distress, aggravated damages and punitive damages in insurance coverage cases.
