Access to Non-Pecuniary Damages under Care First: Submissions and Unknowns

Presented by the CBA Alberta Personal Injury Law (South) & Insurance Law (South) Sections

On August 10, 2026 the Alberta Civil Trial Lawyers Association submitted a framework with support from the CBA working group. This framework provides for ongoing access to non-pecuniary damages under Care First. While ACTLA and the CBA continue to express opposition to the loss of civil rights under Care First, we were pleased with the opportunity to work with the Alberta Government to address this critical access to justice issue.
