Carrie Zeppa and Ruby Sinclair deliver an informative presentation on Matrimonial Real Property (MRP) and the Family Homes on Reserves and Matrimonial Interests or Rights Act (FHRMIRA).
This session covers:
  • An overview of MRP, establishing key legal concepts, terminology, and jurisdictional considerations relevant to practitioners
  • How the legislation applies within First Nations contexts, with particular attention to the legal framework governing the use, possession, occupation, and division of the matrimonial home and associated land interests on reserve
  • The Provisional Federal Rules (PFRs), highlighting how the legal framework operates in communities that have not enacted their own MRP laws, including key procedures, available court remedies, and enforcement considerations
  • The administration of MRP on reserve, outlining the intersecting roles of housing departments, First Nation leadership, and the courts, as well as practical considerations in implementing and navigating MRP processes at the community level

About the Speakers
Carrie Zeppa, a member of Garden River First Nation, has 12 years of experience in First Nation Housing, focusing on training, program management, and building community capacity and wealth.  She joined FNHPA in December 2023 as Manager, Matrimonial Real Property, leading the development and implementation of the on-reserve MRP Program and guiding MRP Regional Consultants in supporting education and awareness for housing staff.
Ruby Sinclair is a member of Flying Dust First Nation in Treaty 6 Territory. She lives on Flying Dust First Nation with her husband and 6 children.  She received a Bachelor of Education and a Juris Doctor from the University of Saskatchewan. Ruby’s legal career includes extensive experience with Indian Residential School Claims and Day School claims.  Ruby is currently In-House legal counsel with Flying Dust First Nation with a focus on the nations corporate division and lands management.
