In the approximately 11 years since the national security review powers were added the Investment Canada Act, only a tiny fraction of foreign investment transactions have raised national security concerns, but for those that have, the consequences have typically been significant. Initially, there was no official guidance as to the circumstances that may trigger a review or influence its outcome. Since mid-2016, the government has provided an increasing amount of information to assist parties navigate the provisions, including official guidelines as well as annual statistics on the number of reviews conducted, their outcomes, buyer country of origin and target industry. Hear this panel of experts from within government and the private sector provide their insights and comparative perspectives on how to assess risk, formulate an approach, and what to do if your transaction is reviewed.
