On May 21, 2020,  the Competition Bureau released its model timing agreement together with guidance on the Bureau’s general approach to the analysis of efficiency claims made by merging parties in defence of a merger. The model agreement includes changes made to the draft version released in July 2019, reflecting feedback received from the legal community as well as the Bureau’s recent investigation of CN’s proposed acquisition of H&R -- the first merger review to make use of the model.  

Join our panel for a discussion on the model timing agreement. We will cover topics such as the learnings from the CN/H&R merger review; the key benefits and challenges presented by the model; and considerations for use of the model timing agreement in the review of notifiable transactions.
