In November 2020, the Competition Bureau released new guidelines regarding buy-side agreements, including no-poach and wage-fixing agreements, which clarified the Bureau’s position that such agreements are not subject to criminal sanctions under section 45 of the Competition Act. This panel will discuss the implication of the Bureau’s statement for the future of buy-side agreements in Canada, as well as any lessons from recent enforcement experience in the U.S.
