Antitrust agencies have historically presumed that most vertical mergers are pro-competitive. However, vertical mergers are now subject to increased scrutiny, particularly in the United States where the Federal Trade Commission recently withdrew its approval of the new Vertical Merger Guidelines. Why this increased focus on vertical mergers? What’s changed in the past few years? And what does the future hold in Canada and the United States? This session brings together an esteemed panel of Canadian and US practitioners, who will address these and other important questions relating to the past, present and future treatment of vertical mergers.
