The Competition Tribunal recently published its decision to dismiss JAMP Pharma Corporation's application for leave to bring an abuse of dominance application against Janssen Inc. Join our panelists as they unpack the Competition Tribunal’s first application for leave decision following the Competition Act's 2022 amendments expanding private access to include abuse of dominance. This brown bag will explore the Competition Tribunal's evidentiary findings, the evolving leave test for abuse of dominance, and the forthcoming June 2025 amendments to the application for leave test.
