This presentation will examine the admissibility of digital evidence in both the criminal and civil context. Topics covered shall include: the legislative framework, obtaining the evidence and discoverability, court-ordered disclosure, digital evidence on Motions, authenticity vs. reliability in the criminal context, authentication/ context/ prejudice in the civil context, Costs, sealing orders and publication bans.
