Discussion on Proposed Amendments to the Marital Property Act
The Family Law Section invites family lawyers in New Brunswick to join a discussion regarding proposed amendments to the Marital Property Act, RSNB 2012, c 107.
The Legislative Services section of the Office of the Attorney General is seeking feedback from members of the family law bar in New Brunswick regarding proposed amendments outlined in Law Reform Note February 2026 #50. The proposed amendments contemplate significant changes to the presumptive principles governing property division for common-law spouses, including equal division of property in common-law relationships, similar to the current treatment of married spouses.
This session will provide an opportunity for family lawyers to:
- Discuss the proposed amendments and the rationale behind them;
- Share their views and practical experience;
- Consider how the proposed changes may affect practitioners and their clients in New Brunswick; and
- Discuss whether the family law bar should provide a joint submission to the Office of the Attorney General or whether individual practitioners should make separate submissions.
The session will be chaired by Emily Wooder MacLeod, Chair of the Family Law Section, Canadian Bar Association – New Brunswick.
