This session will be presented in English on November 25, 2026, and in French on December 2, 2026.
Real estate transactions may at times seem routine, but small errors in practice, file management or trust accounting can create significant problems. This practical program brings together three perspectives on where things can go wrong, and how lawyers can reduce the risks.
Mark Robere, K.C., will discuss real estate practice from the perspective of the Law Society's Practice Review process and the issues that arise in the review of lawyers' practices. Robert Jackson, Insurance Director, will look at the professional liability side, including the kinds of mistakes and circumstances that can result in claims and what they teach us about loss prevention. Michèle Morin, K.C., will address the trust-accounting and compliance issues that frequently arise in real estate practice, including cash transactions, client identification and verification, and source-of-funds requirements. Together, the presenters will offer a practical look at good real estate practice from three complementary perspectives: practice review, claims prevention and trust compliance.
