Discussion of Cowichan Tribes v. Canada (Attorney General)

In August 2025, the BC Supreme Court decision in Cowichan Tribes v Canada (Attorney General) ultimately recognized Aboriginal title to the historic village site of Tl’uqtinus as well as an Aboriginal right to fish the south arm of the Fraser River. Notably, the declaration included submerged lands and lands held in fee simple by Canada, the City of Richmond, the Vancouver Fraser Port Authority and private third parties. This session will address the interaction between Aboriginal Title and fee simple, as well as Aboriginal Title to water or lands submerged in water
