Working with Experts - A Practical Guide for Counsel

Financial experts frequently play a central role in commercial litigation, shareholder disputes, insurance claims, breach of contract matters, fraud investigations, family law disputes, and other proceedings involving economic loss or business valuation issues. However, the value of expert evidence is often determined long before an expert report is issued.

This session provides a practical guide to working effectively with financial experts, focusing on Chartered Professional Accountants (CPAs), Chartered Business Valuators (CBVs), and forensic accounting professionals. Participants will learn how financial experts approach issues such as business valuation, loss quantification with a focus on business interruption and personal injury claims, shareholder disputes, and fraud-related matters. The discussion will focus on the lawyer's role in helping experts understand the issues in dispute, identifying relevant information, challenging and testing assumptions, and ensuring analyses are aligned with the evidence available.

The session will also address key considerations relating to engaging experts, communications with experts, and common challenges encountered.

Drawing on real-world litigation and dispute experience, attendees will gain practical insight into how financial experts develop opinions and how counsel can work with experts to improve the efficiency, reliability, and defensibility of expert evidence.
