The relationship between in-house counsel and their external litigation counsel can be a complex one with differing priorities. This can sometimes cause tension resulting in a less than perfect working relationship. This is especially true when in-house counsel must do more with less, and litigation in the electronic age becomes ever more complex. A new paradigm is needed for this type of relationship so that all parties involved benefit from the expertise of the other. Processes must be developed to streamline the time and expense of litigation, risk must be managed, and both in-house and external litigation lawyers must learn to work together as an integrated team.
