In many class actions, certification is the most hotly contested part of the action. This session will explore the potential of coordinating the certification process in multijurisdictional class actions and the challenges associated with coordination. This session will also address how proposed overlapping class actions are addressed at certification. The recent amendments to the Ontario Class Proceedings Act create a new and higher threshold for certification. Will these amendments affect where a case is best heard? Is there any argument that certification of cases involving Ontario residents should be governed by the new Ontario test, regardless of where certification is heard?

Join three class action judges – The Honourable Justice Branch of the BC Supreme Court, The Honourable Justice Perell of the Ontario Superior Court, and The Honourable Justice Bisson from the Quebec Superior Court – and two experienced class action counsel as they engage in these issues.
