OBA Charity and Not-For-Profit Law PROGRAM | Original Program Date: October 4, 2023
As we approach the end of Ontario’s Not-for-Profit Corporations Act, 2010 (ONCA) three-year transition period, lawyers are likely to face increasingly urgent questions from ONCA corporations. This program is designed to assist lawyers with such requests.
In the first hour of this program participants will first receive a general introduction to the ONCA and be brought up to date on the current status and recent changes to the ONCA. In the second hour, a panel will discuss their diverse perspectives on practical issues that have emerged in practice over the past few years, including:
- Continuance under the Canada Not-for-profit Corporations Act versus the ONCA;
- Competing considerations in membership structures; and
- The “nuts and bolts” of meeting rules including proxies and nominations from the floor.
Participants will gain practice tips for handling and hear emerging interpretations of some of the most common thorny issues that ONCA corporations face when transitioning.
