OBA Civil Litigation PROGRAM | Original Program Date: March 30, 2023
Develop the strategies and practical knowledge that you need to litigate contract interpretation cases in line with today’s evolving legal landscape. The past two years have seen a number of legal developments in contractual interpretation, including in the areas of:
- Releases (Corner Brook (City) v. Bailey),
- The evolving duty of good faith and practical implications following C.M. Callow Inc. v. Zollinger, 2020 SCC 45 and Wastech Services Ltd. v. Greater Vancouver Sewerage and Drainage District, 2021 SCC 7,
- Lessons learned from the pandemic and MAE clauses (Fairstone Financial Holdings Inc. v. Duo Bank of Canada, 2020 ONSC 7397 and Cineplex Inc. v. Cineworld Group plc, 2021 ONSC 8016), and
- Contractual interpretation in agreements with First Nations (Ontario First Nations (2008) Limited Partnership v. Ontario Lottery and Gaming Corporation, 2021 ONCA 592).
Benefit from the valuable insights and tools developed by our expert faculty, many of whom were counsel in the cases to be discussed.
