While Restorative Justice (“RJ”) has been part of Canada’s criminal justice system for over 40 years, it has recently received more attention as an alternative way to address (and seek to repair) the harms caused by a broad range of conduct. As the interest in RJ has grown, there has been much debate about whether it would ever be appropriate in cases involving gender-based violence, including intimate partner violence and/or sexual violence. In recent years, however, many victims of gender-based violence (including sexual violence) have raised concerns about the ways the traditional criminal justice system fails to meet their justice needs – and some have explicitly pushed for alternative models, such as RJ. The Alberta Courts’ Restorative Justice Pilot Project is breaking ground in Canada by allowing for referrals for gender-based violence and sexual violence matters, under certain specific circumstances.
Please join us for a timely discussion as we consider a path forward for restorative justice. In addition to seasoned counsel, we will hear from the Honourable Justice Anna Loparco of the Court of King’s Bench in Alberta about the judiciary’s role in developing and implementing the Alberta Court’s Restorative Justice Pilot Project Framework.
