Indigenous class actions deal with profound harms in Canadian history. The gravity of those harms has increasingly pushed the boundaries of not only substantive Aboriginal law, but also what can – and what should – be accomplished in class actions. 

Join our expert panel to explore how courts are addressing novel claims such as withholding and destruction of culture and underfunding of social services like drinking water, housing, child services, and counselling, as well as the unique and evolving remedies available for such intangible or systemic harms. We’ll also unpack where class actions fit in the broader process of reconciliation, including whether and when class actions are inconsistent with nation-to-nation negotiations and the goals of long-term reform, and the impacts of large fee awards to often non-Indigenous counsel.
