With the rise of AI has come a boom in data centre construction. Some First Nations have led the charge, building a data centre on Manitoulin Island and proposing one around Peace River. Others have resisted, including Sturgeon Lake’s recent victory over Kevin O’Leary’s proposal. Whichever side you and your clients find yourselves on, these cases raise complex issues of treaty rights, use and protection of traditional knowledge and IP, data sovereignty, water and electricity demand, environmental impacts, and tax incentives.
