Environmental and Resources Law: Climate Litigation in Canada: Mapping the Current Legal Landscape
Across the globe, courts are faced with an influx of legal disputes in which climate change science and policy are being given a central position. Climate litigation can range from cases that challenge the sufficiency of governments’ climate policies and laws based on human rights standards through to those in which companies are alleged to have engaged in unlawful “greenwashing” for making false or misleading claims about the climate-related impacts of their products or services. A body of Canadian law is now taking shape, bringing into focus both openings and challenges for climate litigation in Canada. This presentation examines the current legal landscape including newly filed cases and updates from existing lawsuits across the country. It outlines the strategies that appear to be gaining traction, where gaps and inconsistencies between cases and approaches remain, and trends outside Canada that might provide insight into Canadian climate litigation’s future.
